Philippines: DOLE Kalinga to hold consultation on Kasambahay Act

The Department of Labor and Employment (DOLE) Kalinga will conduct a public consultation on the implementing rules and regulation (IRR) of the Kasambahay Act, a new law benefiting household workers, on April 15 here.

Republic Act 10361 known as Kasambahay Law is an Act instituting policies for the protection and welfare of domestic helpers.

Section 4 of the general provisions describes a domestic worker or “kasambahay” as “any person engaged in domestic work within an employment relationship such as but not limited to general house help, nursemaid or “yaya”, cook, gardener, or laundry person, but shall exclude any person who performs domestic work only occasionally or sporadically and not on an occupational basis.”

DOLE Kalinga Chief Alexander Gumabol said the consultation would serve as a venue for the key stakeholders from the grassroots to learn about the new law’s IRR, discuss and provide their inputs and recommendation for the effective implementation of the law.

This he said intends to raise the level of public awareness on the salient provisions of the law aimed at providing adequate welfare and social protection to locally hired domestic workers.

Lourdes Canseco of DOLE said the consultation would be held at the City Sangguniang Panlalawigan Hall to accommodate about 100 targeted participants to include personnel form the Philippine National Police, Department of Education, Municipal Social Welfare and Development Office, Public Employment Service Office Managers, local legislators, media, Philippine Health Insurance Corporation (PhilHealth), Social Security System (SSS), and PAG-IBIG personnel, among others.

Part of the proposed benefits of a domestic workers “who has rendered at least one month of service shall SSS, the Philippine Health Insurance Corporation (PhilHealth), and the Home Development Mutual Fund or Pag-IBIG, and shall be entitled to all the benefits in accordance with the pertinent provisions provided by law.”

It states that “premium payments or contributions shall be shouldered by the employer. However, if the domestic worker is receiving a wage of Five thousand pesos (P5,000.00) and above per month, the domestic worker shall pay the proportionate share in the premium payments or contributions, as provided by law.”

The consultation hopes to result to an IRR where both the rights of the kasambahay and the employer are observed and respected to create a harmonious working relationship.
