Statement by JALA PRT(National Network for Domestic Workers Advocacy) on Occurrence of Violence against DOMESTIC WORKERS Ani (Siti Sri Marni) and 3 PRT Other In Utan Kayu, East Jakarta


Jakarta, February 12, 2016

These days, mass media reported about the cases of violence against domestic workers conducted by her employer. Cases of violence occurred in PRT Ani or full Siti Sri Marni aged 20 years and 3 PRT more E, M, W, done by her employer Meta Hasan Musdalifah (40) in his house located Moncokerto, RT 14 RW 12 Utan Kayu, Matraman, Jakarta East.

       

Violence and torture occurred in his house for a long time until February 8, 2016, after the victim escape. Violent acts of persecution, repression and exploitation - slavery occurred at the victim while working in private homes, as follows:

  • The victim suffered torture and abuse by the perpetrator continuously, day and night. Victims often got hit with a hand or a hard object, poured hot water and ironed. Acts of torture and ill-treatment have resulted in the victim being injured and former violent blunt objects and hot objects: bruises, swelling, and blistering start from the head, ears, nose, lips and other body parts.
  • The workers are also forced (sorry) cat litter
  • Four victims were all working since the age of the child: 12 years, 14 years and 16 years of work in the span of seven years is nothing like Ani and 6 years old and 4 years old. During the work and was at home the perpetrator, the victim worked in a situation not feasible, slavery where victims were being held and wages during the time span worked 7 years, 6 years and 4 years old are not paid.

JALA PRT denounced and strongly deplores crimes of violence and violations of the rights of domestic workers as workers who have been committed by the perpetrator of the employer, as the above incidents committed by employers on top.

Moreover JALA PRT deeply regrets the absence of the State in mmberikan protection and allow continuing absence of violence, exploitation and modern slavery of domestic workers in the country.

Data from various sources in the field of assistance and mass media show in 2015 there were 402. Cases of violence that can be seen because there are agencies that assist and the media and the public are preaching. The majority of 65% is multi violence including unpaid wages, confinement, assault and harassment. In addition to the 35% is human trafficking cases caused by agents and employers. And 80% of cases stop the police level.

This incident is reminiscent of the cases of violence are the same and begins with symptoms similar to lead to fatality. Torture, slavery begins always with insulation and pneyekapan then intimidation and physical violence, economic and even sexual. Including one reminiscent of the tragedy of child domestic workers Sunarsih who later celebrated as the National Day every February 15 PRT.

Sunarsih events happened 15 years ago, in February 2001 in Surabaya. Sunarsih child domestic workers, aged 14 years old from Pasuruan together with four of his friends working in employer - Ny. Ita. During the work 6 months of work, along with four of his Sunarsih is treated as a slave, not paid, fed 1x per day, not allowed out of the house, socializing, sleeping on the floor clothesline. Until then Sunarsih suffer from hunger and take rice. The employer then angry and then persecute Sunarsih up to his neck and body binding with a hose and died. The perpetrator was sentenced to light two years, in fact the perpetrators of violence in the previous PRT in 1999 and 2000, but not prosecuted.

15 years Sunarsih events are celebrated to warn the Parliament and the Government that the state must be present to protect domestic employment situation, it is not getting a response. Indonesia is a country where slavery PRT allowed to proceed and even more rampant. No precautions and legal proceedings against any acts of slavery.

Human rights violations, rights as workers, illegal confinement, persecution, torture of PRT frequent. Absent state and a legal vacuum for protection of domestic workers both at local and national level as well as migrants. This condition is increasingly more systematic space for domestic workers' rights violations, torture, slavery. PRT work in situations not feasible: long working hours are generally more than 14 hours, no breaks and weekly rest, without social security, wages are not paid, the workload is not limited to, vulnerable to abuse and humiliation. How can Parliament and the government keeps a close eye on the domestic situation of their own country? The International community will put Indonesia as a country that is not consistent.

Civil society is represented by JALA PRT had filed a domestic workers law to the Parliament and Government since 2004. 12 years until 3 the 2004-2009 period to the 2009-2014 period and the current period of 2014-2019. Within 12 years of traveling PPRT bill in the House of Representatives since 2004, the bill had become a priority PPRT National Legislation, 2010, 2011, 2012, 2013, 2014 and discussed until Baleg Parliament and then stopped and was discontinued in 2015.

In early 2016, after going through insistence and a very tough debate, the bill was finally PPRT be part of Priority Legislation Changes in 2016 the House of Representatives.

International has been born in the ILO Convention on Decent Work 189 Domestic Workers June 16, 2011. President himself expressed the Indonesian Government will consider this Convention as a reference perundanganan regulations for the protection of domestic workers in the country and migrant domestic workers but the results are very worrying. Parliament and Government. always tough and not recognize domestic workers as workers, there is no legislation and no protection ratification of ILO Convention 189 Decent Work for domestic workers.

It can be said that the second time period SBY and 2 times the period the House of Representatives from 2004 to 2009 and from 2009 to 2014 have failed MEET responsibilities in respect, protection, fulfillment of the decent work situation and rights of Domestic Workers (PRT) as workers. Even the House and the government had let the occurrence of modern slavery situation of domestic workers. This will be the 3rd time in the Government and Parliament failed again. While President Jokowi in Nawacitanya make PRT Protection Act as part of his vision. Will the government, the President and the MOM silent and busy denied the myriad arguments are unfounded. State should move forward and build the country by leaving Slavery.

Therefore the Parliament and the Government should turn and run and fulfill the responsibilities for the respect, protection and fulfillment of the rights of domestic workers as workers. Therefore, it involves acts of violence against domestic workers Siti Sri Marni, Sunarsih PRT and PRT-other, ongoing; and the slow pace of the discussion of law is in the Parliament and the Government, then we submit the following:

  1. Urge the immediate follow-up of the legal process of law enforcement officers as well as police and courts next to conduct legal proceedings against perpetrators Meta Hasan Musdalifah with layered violation bondage of persecution, confinement, unpaid wages.
  2. Urge the Parliament and the Government not to turn a blind eye to cases of violence against domestic workers
  3. Urge the House of Representatives Commission IX and Baleg particular and the Government should immediately discuss and ratify the law is already established as part of Priority Legislation Bill 2016;
  4. Urge the Government: President and Minister of Manpower; Minister of Justice and Human Rights, Minister of State for the PPA to actively take steps embodiment PRT Protection Act and the ratification of ILO Convention 189 PRT Decent Work;
  5. Call local authorities and communities to monitor the situation Domestic Workers who work in their surroundings and take pro-active measures for prevention when encountering a phenomenon that leads to violence.
