Article 43 of the Constitution of India states that the state shall endeavour to secure by suitable legislation or economic organization or in any other way to all workers a living wage, conditions of work ensuring a decent standard of life and full enjoyment of pleasure and social and cultural opportunities.

The right of workers for a fair and living wage has been promoted by the Indian Labour Conference, Supreme Count of India (Raptakos Brett Vs Union of India) and the Constitution of India. But the domestic workers in the state are denied of minimum wages.

Under the Minimum Wages Act, 1948 the State Governments are directed to bring any sector which has 1000 employees in the whole state engaged in such employment, under the schedule of employment and fix minimum rate of wages. Nine States have included domestic workers under the schedule and fixed minimum wages. Delhi has maximum number of domestic workers but State Government has not given attention to this most vulnerable group.

As per the Delhi Government order, issued on 25th September 2014, full time domestic workers are supposed to be paid minimum wages notified by the labour department of the Delhi Government. This is applicable to all domestic workers employed through placement agencies in Delhi. Paying domestic workers meagre amount- which is much lower than the minimum wages- is common in Delhi.
